These Terms of Use apply to individuals who use the Peabody Verify app or interact with location verification powered by Peabody Compliance technology. If you are a business or developer integrating our services, please see our Business Terms of Service.

In plain language: The Peabody Verify app checks that you are physically located where you say you are. By using it, you agree to these terms. You are not being charged anything — the platform you signed up with has arranged for this verification on your behalf.

1. What the Peabody Verify App Does

The Peabody Verify app performs a secure, one-time or periodic location verification on behalf of the platform or application you are using (your "operator"). It checks signals from your device — including GPS, nearby Wi-Fi networks, and device integrity indicators — to confirm that you are physically located in a permitted area, and that your device has not been tampered with to produce a false location.

Peabody does not operate a consumer-facing platform or hold an account with you. Our service is provided to your operator, who is responsible for how verification results are used in their application.

2. Acceptance of These Terms

By launching the Peabody Verify app and granting location permission, you agree to these Terms of Use and our End User Privacy Notice. If you do not agree, you may close the app without granting location access. Declining will prevent the verification from completing, and your operator's platform may restrict your access to certain features as a result.

3. Your Consent to Location Verification

Before collecting any location data, the app will ask for your express consent. Your consent is voluntary. You may withdraw it at any time by:

Withdrawing consent does not affect the lawfulness of any processing that occurred before your withdrawal. It may, however, affect your ability to use features of your operator's platform that depend on location verification.

4. Accurate Information

You agree not to use any tools, applications, or methods designed to falsify, simulate, or spoof your device's location, including but not limited to mock location apps, VPNs used for location masking, or jailbroken device exploits. Attempting to deceive the verification system may violate the terms of the platform you are using and, depending on the context, may violate applicable law.

5. Intellectual Property

The Peabody Verify app, including its software, design, and underlying technology, is the exclusive property of Peabody Software, LLC and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app solely for its intended purpose of completing a location verification. You may not copy, modify, reverse engineer, or distribute any part of the app.

6. No Fees

The Peabody Verify app is provided to you at no charge. Your operator has arranged and paid for the verification service on your behalf. Peabody will never charge you directly for a location verification.

7. Disclaimer of Warranties

THE PEABODY VERIFY APP IS PROVIDED "AS IS" AND "AS AVAILABLE." PEABODY SOFTWARE, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT EVERY LOCATION DETERMINATION WILL BE PERFECTLY ACCURATE IN ALL CIRCUMSTANCES.

GPS accuracy is subject to physical conditions outside our control, including signal obstructions, device hardware limitations, and environmental interference. A verification result reflects the best available signal data at the time of the check.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEABODY SOFTWARE, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PEABODY VERIFY APP, INCLUDING BUT NOT LIMITED TO ANY DECISION MADE BY YOUR OPERATOR BASED ON A VERIFICATION RESULT.

IN NO EVENT SHALL PEABODY SOFTWARE, LLC'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP EXCEED ONE HUNDRED DOLLARS ($100.00 USD). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Operator Responsibility

Peabody provides the verification result to your operator — we do not control what your operator does with that result. Decisions about access, eligibility, or account status made by your operator based on a verification result are solely the operator's responsibility. Any disputes about how a verification result was applied to your account should be directed to your operator's customer support team.

10. Children

The Peabody Verify app is not intended for use by individuals under the age of 13. The platforms that rely on our verification technology are required to restrict access by minors under applicable law. If you are under 13, do not use this app. If you believe a child has used this app in error, contact us at support@peabodycompliance.com.

11. Governing Law

These Terms of Use and any dispute arising out of or related to them or your use of the Peabody Verify app shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

12. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the app — including questions about its scope or applicability — shall be resolved by binding arbitration in Orlando, Florida, administered by a recognized arbitration provider (such as JAMS or AAA) under its consumer arbitration rules.

Arbitration means a neutral arbitrator will resolve the dispute instead of a judge or jury. You and Peabody each waive the right to a trial by jury and the right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

13. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect when changes were made. Continued use of the Peabody Verify app after updated Terms are posted constitutes your acceptance of the changes.
